Thank you for choosing to take part in one of my online courses or memberships. These Terms of Use are here to ensure that we all enjoy a safe, respectful, and inspiring creative space. Please take a moment to read through them before enrolling.

By registering for any of Art Attuned Ltd (Kaisa Hart) online courses, you agree to the following terms:

Membership Terms of Use:

By joining Kaisa Hart’s membership The Mindful Artist Collective, you agree to the following terms:

1. Membership Access

Your membership includes access to member materials — including videos, downloads, printables, blog posts, and replays — for as long as your subscription remains active. If you cancel, access ends at the end of your current billing period.

2. Payment & Cancellation

This is a subscription-based service. You will be billed monthly or annually depending on your chosen plan. You may cancel your membership at any time via your account settings. Refunds are not provided for partially used periods.

3. Right of Withdrawal

Under Finnish consumer law, you have a 14-day right to cancel your purchase. However, by joining, you agree that your access to digital content begins immediately, and you thereby waive this 14-day right of withdrawal.

4. Personal Use Only

All content is for your personal, non-commercial use. You may not share, distribute, or resell any part of the membership materials without written permission.

5. Community Guidelines

If you participate in the optional private community, please show up with kindness and respect. Harmful, inappropriate, or disrespectful behaviour will result in removal without refund.

6. Coaching Disclaimer (VIP Members)

1:1 coaching included in the VIP membership is not therapy. It is a creative and supportive space informed by coaching and expressive arts practices. Kaisa Hart is not a licensed therapist. These sessions are not a substitute for mental health care. All offerings in general are intended for personal growth and inspiration.

7. Content Delivery & Modifications

All membership content will be delivered in a timely manner. The rhythm and structure may evolve over time to best serve members.

8. Your Account, Data & Technical Access

You are responsible for keeping your login details secure. All personal data is handled in accordance with GDPR. You can read our full Privacy Policy for details on how your information is used.

While every effort is made to keep the platform accessible and running smoothly, Kaisa Hart is not liable for temporary disruptions beyond her control (e.g. platform outages, internet issues, or tech bugs).

9. Governing Law

These terms are governed by Finnish law. The Finnish Competition and Consumer Authority (Kilpailu- ja kuluttajavirasto, KKV) oversees the enforcement of consumer rights. Any disputes will be resolved according to Finnish consumer protection regulations.

10. Upgrading or Downgrading Your Membership

If you choose to upgrade or downgrade your membership (for example, switching between standard and VIP, or monthly and annual plans), ThriveCart (the course platform) handles this automatically using a pro-rata credit system.

This means:

– When you switch plans, your current subscription is cancelled immediately.
– ThriveCart automatically calculates a credit for any unused time on your existing subscription.
– This credit is then applied toward your new subscription, and you’ll only be charged the difference (if upgrading) or won’t be charged again until the credit runs out (if downgrading).

Your membership access will continue without interruption, and all plan changes are processed smoothly behind the scenes.

Please note: There are no refunds on membership payments. Any plan changes are handled as credits within the system.

11. Membership Cancellation & Billing Terms

You are welcome to cancel your membership at any time. Once cancelled, your access will remain active until the end of your current billing period, after which your membership will not renew.

Please note the following:

  • No pro-rated refunds are offered for unused time. ThriveCart (membership platform) does not support partial refunds for unused days within a billing cycle. When you cancel, your access will continue until the end of your paid term, and no further payments will be taken.

  • No automatic confirmation email is sent upon cancellation. If you would like written confirmation, please feel free to email me at kaisa@kaisahart.com and I’ll be happy to send one.

  • It is your responsibility to cancel before your next billing date if you do not wish to be charged. Late cancellations may result in charges that cannot be refunded. Allow at least 3+ business working days for the cancellation process.

  • If your payment fails, ThriveCart will attempt to process it again automatically. If the payment continues to fail, your access may be paused or removed, and rejoining the membership may require paying the current membership rate, which could be higher than your original rate.

  • If you're experiencing payment issues but would like to remain a member at your current rate, please contact me as soon as possible at kaisa@kaisahart.com so we can resolve it together.

By joining this membership, you agree to these terms and acknowledge that all cancellations must be processed by you through the account management system (or by contacting me directly if you need help).

REFUND POLICY

ONLINE COURSES: Refunds are available within the first 7 days of the course start date, provided that you have watched less than 50% of the course content. This does not apply to the Membership: The Mindful Artist Community.

MEMBERSHIP: The Mindful Artist Community: Under Finnish consumer law, you have a 14-day right to cancel your purchase. However, by joining, you agree that your access to digital content begins immediately, and you thereby waive this 14-day right of withdrawal. There are no refunds. Please note: All membership payments are non-refundable. If you choose to cancel, you’ll continue to have access until the end of your current billing period.

Your course & membership registration grants you personal, individual access only. Sharing your login details with others is strictly prohibited as a matter of fairness to your instructor, fellow participants, and out of respect for intellectual property.

You may not distribute, reproduce, or publicly share any portion of the course or membership content, including videos, PDFs, or other materials. All course content is protected under copyright law.

TECHNICAL REQUIREMENTS

To access and fully enjoy the courses & memberships, you need:

  • A reliable high-speed internet connection

  • A modern device (computer, tablet, or smartphone) with an up-to-date browser

  • Sufficient bandwidth to stream high-quality video without frequent interruptions

I am not responsible for any technical issues on your end, including but not limited to slow internet, outdated devices, browser incompatibilities, or interference from other applications. I recommend using a laptop or desktop computer for the best experience. If you encounter technical difficulties, I will do my best to assist you, but I cannot guarantee solutions for issues beyond my control. No refunds will be provided due to individual technical difficulties.

Additionally, I am not liable for any disruptions caused by external service providers, such as hosting platforms, video streaming services, or social media networks.

ONLINE COURSE ACCESS & DELIVERY

  • Upon registration, you will receive login details via email when the particular course begins.

  • Course materials—including text, images, videos, and links—are hosted in a password-protected classroom.

  • Your course purchase includes lifetime access, meaning you can revisit the content for as long as I continue to run my business.

“Lifetime access” refers to the lifetime of the course or my business. While there is no set end date, I reserve the right to retire or remove content at any time. Where possible, you will receive at least 14 days’ notice and the option to download course materials so you can keep them.

As part of the course, you may be invited to join a private online community (e.g., a Facebook group) to connect with fellow participants. Participation in this group is optional and provided as a complimentary bonus feature, not a paid service. I reserve the right to modify, archive, or remove the group at any time.

Participants must engage respectfully and constructively within all course-related platforms. Bullying, harassment, spam, or promotional content unrelated to the course is not permitted and may result in immediate removal without refund.

CONTENT & COMMUNITY GUIDELINES

Some of my online courses and memberships may feature content provided by guest contributors. These materials remain the sole property of their respective authors and, like all course materials, are protected under copyright law.

If you choose to join a private community group associated with the course, you agree to follow the group guidelines. As the administrator, Kaisa Hart reserves the right to deny or revoke access to the group at any time. Additionally, I may temporarily archive or permanently delete the group as needed.

By participating in my courses and creative communities, you agree that all communication between administrators and participants remains strictly confidential. It is essential that these spaces remain supportive and safe for everyone involved.

It is strictly prohibited to teach or replicate any of the techniques, processes, or knowledge learned in my courses for commercial or instructional purposes. These methods are the result of years of research and development and remain my intellectual property. While I encourage you to create and share your personal artwork, you may not use the course teachings to conduct paid or unpaid classes.

All course materials, including but not limited to videos, PDFs, text, images, exercises, and creative processes, are protected by international copyright laws. No part of this course may be reproduced, recorded, or distributed in any form without explicit written permission from Kaisa Hart.

LIABILITY DISCLAIMER

By enrolling in my courses, you acknowledge that you are responsible for your own safety while using any art supplies, tools, or techniques presented in the lessons. I am not liable for any accidents, injuries, or damages that may occur during or after taking the course.

PRIVACY POLICY

By signing up to one of Kaisa Hart’s online courses or memberships, you agree to receive emails from me regarding course updates, future offerings, and art-related content. You can unsubscribe at any time, though doing so may result in missing important course-related notifications.

Additionally, by participating in the course and/or membership, you grant me permission to use any images you share within the course platform, via email, or in the private community group (e.g. Facebook) for marketing and promotional purposes. Your rights to your artwork remain yours. If you wish to have an image removed, please contact me at kaisa@kaisahart.com.

Likewise, any testimonials or feedback you share may be used for promotional purposes. If you prefer to remain anonymous or would like your testimonial removed, please reach out to me.

CHANGES TO TERMS OF USE

I reserve the right to update these Terms of Use as needed. Any changes will be reflected on this page, with the last modified date updated accordingly. By continuing to access my courses after changes are made, you accept the revised terms.

DISCLAIMER ON RESULTS

Results may vary. Participation in this course does not guarantee specific outcomes, either creatively, personally, or professionally. Your experience and growth are unique to your own practice and engagement with the material.

GOVERNING LAW & JURISDICTION

These Terms of Use are governed by and construed in accordance with the laws of Finland (EU jurisdiction), and any disputes arising in relation to these terms shall be subject to the exclusive jurisdiction of the courts in Finland.
